1. Important Information – Basic Requirements & Client (your) Responsibilities
- 1.1 Arrival time, to allow for equipment set-up and checks, is usually around 2-4 hours before the start time mentioned in your 'Booking Enquiry'. Similarly, around 90 minutes is required to clear the equipment after the entertainment. The Client is responsible for ensuring the venue is aware of this.
- 1.2 Free/client paid onsite (or nearby off-street) parking required
- 1.3 Private & secure changing/storage area required (Public spaces/toilets/cleaning
- 1.4 The Client is responsible for providing and ensuring a safe working environment for the performer and all equipment and, as such, will be liable for any injury or damage to the performer and equipment in the event of any actions or interaction by the events guests or visitors.
- 1.5 Public Liability & equipment insurance covers the named policy holder ONLY. As such, use or interaction of any and all equipment by any other person, with or without permission, is STRICTLY PROHIBITED. Doing so will void ALL insurance policies and render the user liable for ALL injury or damage resulting from the use or misuse of the equipment.
- 1.6 Indoor events and ‘Habitable’ venues and only with mains electricity
- i) 2x separate 230v plug sockets required.
- ii) Set up area of: (minimum W6’ x D4’ x H6’6”) (ideal W20’ x D8’ x H8’6”)
- 1.7 Price quoted is based on a performance in ONE LOCATION/AREA ONLY
- 1.8 Client Mobile number is required for informing client of departure and/or arrival and requesting directions (if needed). If this number is not supplied (or is unobtainable /unanswered when required), then no liability will be accepted for any arising late arrival and any subsequent part or non-performance.
- 1.9 Entertainment (booked) times are strictly as mentioned in your 'Booking Enquiry'. This may be extended by a maximum of 30 minutes with the performers and venues agreement. Subsequent Performer Agreeable overruns will be charged at £50 per 30 minutes, or part thereof
- 1.10 For venue specific bookings and discounts, please be aware that Any misrepresentation regarding the venue in order to attempt to obtain any offers or discounts will result in the booking becoming void. Any deposits and balances will then be retained and the booking Terminated.
- 1.11 By Accepting the Booking (Sec: 2.3) you are indicating your agreement to (and confirmation of) all the details and terms & conditions relating to the Bookings, as well as acknowledging that the limit of my Liability in any event, will be up to, but not exceeding, the amount you have paid me.
2. Booking

A ‘Booking Confirmation’ will be actioned after you confirm your acceptance and agreement to (and of) the information contained within the ‘Booking Enquiry’ and the Booking Terms & Conditions.
- 2.1 Bookings are taken on a First Come, First Served basis.
- 2.2 A Booking is not confirmed until a ‘Booking Confirmation’ email has been sent
A ‘Booking Confirmation’ will be actioned after you confirm your acceptance and agreement to (and of) the information contained within the ‘Booking Enquiry’ and the Booking Terms & Conditions.
- 2.3 Confirmation and Acceptance of the agreement can be shown by (Depending on the otions given to you in your Booking Enquiry):
- i) Submitting a DEPOSIT or FULL PAYMENT by the date specified (Valid Until/Due Before) in your ‘Booking Enquiry’
- ii) Returning a Signed Copy of your ‘Booking Enquiry’ (usually page 9). You can find help on how to do this at: www.Swing-Singer-Rat-Pack-Tribute.weebly.com/sign
- iii) Checking and completing the ‘Agree’ section in your ‘Client Area’ of the website
- iv) Clicking the ‘Authorise Ernie to Sign This on Your Behalf’ link in the email sent to you containing your ‘Booking Enquiry’.
3. Deposits
- 3.1 A Deposit does NOT confirm your Booking. It is an indication of your intention to complete a Booking
- 3.2 A Deposit will preliminarily reserve your requested date for a time specified (Date Reserved Until) in your ‘Booking Enquiry’ (usually 90 days before the Event Date)
- 3.3 Deposits are Fully Refundable for cancellations completed within the time specified (Refundable Up To) within your ‘Booking Enquiry’
- 3.4 By submitting a Deposit, you are confirming your acceptance and agreement to (and of) the Information contained within the ‘Booking Enquiry’ and the Booking Terms & Conditions.
- 3.5 Upon receipt of your deposit, the event details will be included in the calendar and your requested date and time will be reserved for the time period specified in your Booking Enquiry
- 3.6 If the Remaining Balance has not been received within the reservation period, (non payment) and the Cancellation process has not been completed, then the proposed Booking will be Terminated. In such case, no refunds will be eligible.
4. Invoices
- 4.1 For pre-agreed ‘invoiced’ events, 100% of the ‘Invoice Total’ is due for all engagements cancelled by you (in accordance with the cancellation procedure) with less than 60 days notice of the event date. You are required to confirm your understanding and acceptance of this (as well as all other information and Terms & Conditions) by:
- i) Submitting a DEPOSIT or FULL PAYMENT by the date specified (Valid Until/Due Before) in your ‘Booking Enquiry’

- iii) Checking and completing the ‘Agree’ section in your ‘Client Area’ of the website
- iv) Clicking the ‘Authorise Ernie to Sign This on Your Behalf’ link in the email sent to you containing your ‘Booking Enquiry’.
- i) Submitting a DEPOSIT or FULL PAYMENT by the date specified (Valid Until/Due Before) in your ‘Booking Enquiry’
- 4.2 The default Payment Terms stated in the invoice (if applicable) are normally set to 'In Advance' . It is your responsibility to ensure this is acceptable BEFORE Accepting/Confirming the Booking Details, as there is an admin fee of an additional £15 if this needs to be changed after the Booking has been Confirmed. Please request this to be changed BEFORE confirming the booking to avoid the additional charge.
- 4.3 Overdue/Unpaid invoices may be passed to a collection agency/service and any additional fees/charges will be added to the total amount due, as well as any late payment interest.
5. Changes to the Booking Details
- 5.1 If you wish to make any changes to your planned event, please Contact Ernie as soon as possible.
- i) It may cost you a bit more if you make changes to (including but not limited to) the events date, venue or location, performance times, the start/finish times of your event or Ernie’s time on location at the venue.

- 5.2 No Changes can be made or accepted once the booking is confirmed.
- 5.3 The price quoted is valid for 1 performance (of an agreed number of sets) in 1 location/area only.
- i. Once the equipment set-up has begun, neither the performer or equipment will move to another location to perform. If you require entertainment in multiple locations (within the same building) please make this known BEFORE submitting a deposit/payment or otherwise confirming your acceptance of the booking.

Please remember that the price you have been given is based on the information contained in your 'Booking Enquiry'
6. Cancellations
- 6.1 If, after making any payments, you wish to cancel a booking, please go to the 'Cancellations' section of the website (which can be found at: www.Swing-Singer-Rat-Pack-Tribute.weebly.com/cancellations.html - a copy of which can be sent upon request) as soon as possible and follow the simple process as indicated.
- 6.2 The cancellation process is complete when you receive a Cancellation Confirmation email and Cancellation Reference.
- 6.3 In the unlikely event that Ernie cancels the booking for any reason, you will be refunded in full. This excludes Bookings Terminated under [Sec: 1.10, Sec: 2.6]
- 6.4 Please be aware that for pre-agreed ‘invoiced’ events, 100% of the ‘Invoice Total’ is due for all engagements cancelled by you (in accordance with the Cancellation procedure) with less than 60 days notice of the event date.
- 6.5 For performances cancelled due to Government issued instructions, you will be refunded in full. For pre-agreed Invoiced events that are cancelled due to Government instructions with less than 30 days’ notice of the event, the invoice will be waived and no payment will be due.
7. Refunds
- 7.1 Eligible refunds will be issued in accordance with the Booking Terms & Conditions, along with your chosen 'Payment Option'
- 7.2 For non attendance or non performance on my part due to any illness, emergency, equipment failure or vehicle breakdown, then you will be refunded in full with as much notice as I can possibly give you. This excludes reasons mentioned in [Sec: 1.8, Sec: 1.10, Sec: 3.6]
- 7.3 For any part attendance or part performance on my part, due to any illness, emergency, equipment failure or vehicle breakdown , I will refund you in part based on the actual (pro rata) performance time. This excludes reasons mentioned in [Sec: 1.8, Sec:1.10, Sec: 3.6]
- 7.4 For any part performance or non-performance due to any reasons beyond my control (including but not limited to) power failure in the building, fire, flood, evacuation, fighting amongst guests/visitors, speeches, client/guest activities, late service (venue, client or guest) or any other reason that my performance is prevented, delayed or interrupted, then you will not be refunded.
- i) Any equipment failure or performance interference due to client/guest/3rd party intervention by use or misuse of any equipment or it's power supply and/or function will be deemed as being beyond my control. As such, the use of the equipment for playing music or broadcasting any sound other than is already installed/available on/to the equipment with or without permission is strictly prohibited. This includes (but is not limited to) WiFi transfers, Bluetooth transfers, USB dongles, Ipods, CD's, 'Cloud' files or any other method of music/sound/file transfer
- i) Any equipment failure or performance interference due to client/guest/3rd party intervention by use or misuse of any equipment or it's power supply and/or function will be deemed as being beyond my control. As such, the use of the equipment for playing music or broadcasting any sound other than is already installed/available on/to the equipment with or without permission is strictly prohibited. This includes (but is not limited to) WiFi transfers, Bluetooth transfers, USB dongles, Ipods, CD's, 'Cloud' files or any other method of music/sound/file transfer
- 7.5 Please be aware that it may not be possible to issue refunds via PayPal (as there are 60 day refund limits). Although PayPal is the preferred method, Bank Transfers may be necessary.
